The terms covering this website, and the framework a paid engagement sits inside. Where the two conflict, the signed engagement agreement wins.

01The agreement

These terms govern your use of this website, operated by Wisest Digital of Rajkot, Gujarat 360005, India. By using the site you accept them. If you do not, stop using the site.

These terms are not the contract for paid work. Every engagement is governed by a separate written agreement — a statement of work, a master services agreement, or both — which sets out scope, fees, deliverables, timelines, and the parties’ obligations. Where anything in that agreement conflicts with this page, the agreement wins.

02What the website is

This site describes what we do and invites you to start a conversation. Its content is provided for general information. It is not an offer capable of acceptance, a quotation, a guarantee of availability, or professional advice on your specific situation.

We may change, add, or withdraw any part of the site at any time. We try to keep it accurate, but we do not warrant that every page is complete or current at the moment you read it.

03How engagements work

Sending an enquiry does not create a contract and places no obligation on either side. We may decline an enquiry without giving a reason, and we sometimes do — including when we think AI is the wrong tool for the problem described.

An engagement begins only when both parties sign a written agreement. That agreement will define, at minimum: the scope of work, the deliverables, the fee and payment schedule, the duration, the change-control process, and the data processing terms.

Scope changes are handled through change control rather than absorbed silently. Where a change materially affects cost or timeline, we say so before doing the work, not after.

04What we need from you

Our work depends on inputs only you can supply. Under an engagement you are responsible for:

  • Providing accurate information, access, and data in the form and timeframe agreed.
  • Holding the rights and lawful basis necessary for us to process any data you give us, including any consent required from your own users.
  • Nominating people with authority to make decisions and give approvals.
  • Reviewing and testing deliverables against the acceptance criteria in the agreement.
  • Operating the delivered system after handover, or telling us in advance that you need us to.

Delays caused by inputs not arriving move timelines. We will flag that when it happens rather than absorbing it and reporting a slip later.

05Fees and payment

Fees, currency, invoicing schedule, and payment terms are set in the engagement agreement. Unless that agreement says otherwise, invoices are payable within the period stated on the invoice, and fees are exclusive of taxes, duties, and third-party costs such as model API usage, hosting, or licensed tooling.

Third-party running costs incurred on your behalf are passed through at cost and identified separately. We do not mark them up without saying so in the agreement.

We may suspend work on materially overdue invoices after giving written notice.

06Intellectual property

The content of this website — text, layout, design, and code — belongs to us or our licensors. You may read it, share links to it, and quote it with attribution. You may not republish it as your own.

For engagement work, ownership is set in the engagement agreement. Our default position: on full payment, you own the deliverables built specifically for you. We retain ownership of our pre-existing tools, methods, frameworks, and general know-how, and grant you the licence needed to use the deliverables as intended. We do not claim ownership of your data or your content at any point.

07Confidentiality

Information you share with us in confidence stays confidential, whether or not it is marked as such, and whether or not an engagement follows. That includes what you tell us in a first conversation about a problem you have not made public.

We do not publish a client name, logo, metric, or narrative without that client’s prior approval. Where case studies appear on this site, they are anonymised by default and published only with consent.

08AI systems: what we do and do not warrant

AI systems are probabilistic. A well-built system will still be wrong sometimes, and no engineering practice available today changes that. Anyone who tells you otherwise is selling something.

We warrant that we will perform our services with reasonable skill and care, to the standard of a competent professional in this field. We do not warrant that any AI system will be free of errors, will never produce an incorrect or misleading output, will perform identically on data it has not seen, or will meet a specific accuracy figure unless that figure is written into the engagement agreement as an acceptance criterion with a defined test.

Where a system’s output informs a decision with legal, financial, medical, or safety consequences, meaningful human review is a requirement, not an option. Our engagements are designed on that basis, and we will not build a system intended to remove it.

09Limitation of liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.

Subject to that, and in relation to your use of this website, we are not liable for indirect or consequential loss, loss of profit, loss of revenue, loss of anticipated savings, loss of business opportunity, or loss or corruption of data.

Liability arising from paid work is governed by the cap and exclusions in the relevant engagement agreement, which are negotiated with each client rather than imposed by this page.

10Markets we do not serve

We do not accept engagements from, or provide services into, the following jurisdictions:

  • Iran · Iraq · Sri Lanka · Pakistan · Bangladesh · Israel · Myanmar · Syria · North Korea · China · Turkmenistan · Eritrea

This restriction applies regardless of where an enquiry originates or where the contracting entity is registered. Enquiries falling within it are declined.

You must not use this site or our services in breach of any sanctions, export control, or trade restriction that applies to you.

11Acceptable use

You may not use this site to attempt unauthorised access to any system, to interfere with its operation, to scrape it at a volume that degrades service for others, to transmit malicious code, or to submit unlawful, deceptive, or abusive content through the enquiry form.

We do not undertake engagements to build systems whose primary purpose is unlawful, deceptive, or designed to cause harm — including surveillance of individuals without a lawful basis, generation of content intended to deceive about its origin, or circumvention of safety controls in another party’s systems.

12Cancellation policy

Either party may cancel an engagement in writing, subject to the notice period recorded in the engagement agreement. Sending an enquiry or receiving a proposal commits you to nothing and can be stopped at any point, because no contract exists until one is signed.

Cancellation before work begins releases you from the engagement on payment of any third-party costs already committed on your behalf and not recoverable. Cancellation after work begins settles fees for the work actually performed to the effective date, assessed against the deliverables and milestones in the agreement.

Recurring services — retainers and managed campaigns — are cancelled with written notice and stop at the end of the period already paid for. Work continues through that period.

The full position, including milestone-based work and what happens when we cancel, is set out on the Cancellation & Refund Policy page.

13Refund policy

Amounts paid in advance for work that has not been performed at the point of cancellation are refunded. Amounts covering work already performed, and milestones already delivered and accepted, are not — custom engineering and creative work is built for one client and cannot be recovered or resold.

Where we materially fail to deliver what was agreed and do not correct it within a reasonable period after being told, you are refunded for work paid for and not delivered. Where delivered work does not meet the agreed acceptance criteria, the remedy is correction under the agreement rather than a refund, and that obligation survives delivery.

Refund requests are made in writing with the engagement or invoice reference. We confirm in writing what has been performed and what is owed before anything is processed, and approved refunds are returned by the original payment method where the provider allows it.

Nothing here removes a statutory right that cannot be excluded by agreement. The detailed policy, including recurring services and media spend, is on the Cancellation & Refund Policy page.

14Suspension and termination

We may restrict access to the site if we reasonably believe these terms are being breached.

Termination of an engagement is governed by the engagement agreement, which will set notice periods, the treatment of work in progress, and what happens to your data on exit.

15Governing law

These website terms are governed by the laws of India, and the courts of Rajkot, Gujarat have jurisdiction over disputes arising from them.

The governing law and jurisdiction for a paid engagement are agreed in that engagement’s contract and are frequently not Indian law — we contract under the law our client’s procurement process requires where that is reasonable.

16Changes to these terms

We may update these terms. The last-updated date at the top of this page changes when we do. Continued use of the site after a change means you accept the revised terms. Changes to this page never alter a signed engagement agreement.

Questions

A question about this policy, or a request under it, goes to the same place as everything else.
